These Terms of Service are an agreement between you and Hawil Ventures LLC, operating as Hawil AI. By using our AI-powered webcall services, you acknowledge that you have read, understood, and agree to comply with the terms, policies, and legal obligations outlined below.
You are solely responsible for ensuring that your use of our AI webcall agents is lawful, ethical, and compliant with all applicable regulations.
1. Legal Compliance for AI Webcall Agents
The use of AI webcall agents for inbound, user-initiated automated voice interactions is governed by applicable laws. Key areas of compliance include:
- Consent: For inbound webcalls, initiation implies consent. Clear disclosure that the user is speaking with an AI agent remains critical.
- State-Specific Laws: Many states have their own regulations regarding voice interaction recording (one-party vs. two-party consent).
- Data Privacy (GDPR, CCPA, BIPA): Voiceprints can be biometric data. You must adhere to strict standards when collecting/processing voice data.
- Disclosure: You must clearly disclose at the start of any interaction that the recipient is speaking with an AI agent.
2. Your Responsibilities as a User
- Obtain Consent: Ensure proper implied or explicit consent based on local regulations.
- Clear Disclosure: Always state the interaction is handled by an AI agent.
- Respect Discontinuations: Provide an easy way for individuals to end the interaction.
- Lawful Use Only: No fraudulent, abusive, or harassing activities.
- Adhere to Recording Laws: Comply with all applicable one-party or two-party consent laws.
3. Prohibited Activities
- Exceeding implied consent or failing to make necessary disclosures.
- Impersonating individuals, celebrities, or public officials without authorization.
- Using the service for scams, fraud, or spreading misinformation.
- Harassing or abusing individuals.
4. Text Chatbot & AI Chat Services
Hawil AI provides an embeddable text chatbot that answers visitor questions using your business knowledge base. By enabling the chatbot feature, you agree to the following:
- Session Limits: Each chatbot session is capped at 50 messages to protect business owners from excessive costs.
- Rate Limiting: Visitors are rate-limited to 10 requests per minute and 100 requests per hour to prevent abuse.
- Lead Capture: Chatbot includes an optional lead capture form. Visitors may skip it to remain anonymous. Business owners are responsible for how they use any lead data collected.
- Data Accuracy Disclaimer: Chat data depends entirely on visitor participation. Anonymous visitors produce less structured analytics than identified visitors. Business owners should not treat chatbot session scores with the same confidence as voice call scores, as chat interactions are inherently less structured.
- Anonymous Visitors: Business owners acknowledge that visitors may not provide personal information. Hawil AI is not responsible for incomplete or missing lead data from anonymous chatbot sessions.
- Chatbot Billing: Chatbot sessions cost $0.02 per session for subscribers or $0.10 per session for non-subscribers, after your free monthly quota. Free sessions reset monthly and do not roll over to the next billing period.
5. Credits & Billing
Hawil AI operates on a credit-based system. By using the service, you agree to the following billing terms:
- Minute Rounding: All AI voice calls are charged **per minute**. Any fraction of a minute used will be rounded up to the nearest whole minute (e.g., a 10-second call will be charged as 1 full minute).
- No Refunds: Purchased credits are non-refundable and should be used while your subscription is active. Credits are not refunded upon subscription cancellation.
- Liability: Hawil AI is not responsible for credits spent due to user error in campaign setup or contact list management.
- Text Chatbot Sessions: Text chatbot sessions are billed per session ($0.02 for subscribers, $0.10 for non-subscribers) after your free monthly quota. Each session allows up to 50 messages.
6. AI Technology Disclaimer & Limitations
Hawil AI utilizes artificial intelligence technology to power voice and text interactions. By using our services, you acknowledge and accept the following inherent characteristics and limitations of AI technology:
- Evolving Technology: AI is a rapidly evolving field. The capabilities, behaviors, and outputs of AI systems may change over time as the underlying models are updated and improved.
- Potential for Inaccuracies (Hallucinations): AI systems can generate responses that sound confident but are factually incorrect. This phenomenon, known as "hallucination," means the AI may provide inaccurate information about your business, products, services, or policies.
- Off-Topic Responses: AI agents may occasionally deviate from the intended conversation topic, provide irrelevant information, or fail to stay within the boundaries of your business context.
- No Guarantee of Accuracy: While we strive to provide accurate and helpful AI interactions, Hawil AI does not guarantee the accuracy, completeness, or reliability of any AI-generated responses.
- User Verification Required: You are responsible for reviewing AI outputs and verifying information before relying on it for business decisions or communicating it to customers.
Important: Smart Agent & Write Operations
When using Smart Agent features that perform "write" operations (such as scheduling appointments via Calendly, creating CRM records, updating customer data, or any action that modifies external systems):
- You should regularly review and verify all actions taken by the AI agent.
- Confirm that scheduled appointments, created records, and data modifications are accurate and intended.
- Hawil AI is not responsible for errors, double-bookings, incorrect data entries, or unintended actions performed by AI agents through integrated services.
- You retain full responsibility for monitoring and correcting any AI-initiated actions in your connected systems.
By enabling AI-powered features, you accept these inherent limitations and agree to implement appropriate oversight and verification processes for your business use case.
7. Limitation of Liability
Hawil AI provides the technology platform but is not responsible for how you use it. You agree to indemnify Hawil AI from any claims, fines, or damages arising from your failure to comply with applicable laws.
You are solely liable for the content of your campaigns and your adherence to legal requirements.
